Were You Injured at an Amusement Park in Knoxville? Recent Theme Park Malfunction Traps 28, Raises Questions about Rights of Amusement Park Accident Victims in Tennessee

AmusementParkRiders

The story of an amusement park malfunction that trapped 28 people in Oregon went viral this week, and raises questions in many Tennessee residents’ minds about the rights and options of amusement park accident victims under Tennessee laws. According to national news reports, CBS News, the terrifying amusement park accident that left the almost-30 theme park-goers suspended upside down in mid-air happened on an otherwise regular Friday afternoon. On Friday, June 14, 28 amusement park patrons of the Oaks Park amusement park in Portland, Oregon, found themselves trapped upside down on the AtmosFEAR attraction, a ride that “operates like a pendulum”, swinging its riders topsy-turvy. The ride had been in operation at the century-old Oaks Park amusement park since 2021, without incident. On that Friday, however, riders of the AtmosFEAR got much more of a fright than they bargained for when the ride suddenly stopped during the upside-down portion of the ride. One rider said of the incident, “My entire bladder hurts. I was holding back throw-up. My legs are killing me”. Another stated about the scene around him on the ride that people were “praying to God, screaming for their life, throwing up, passing out” while they waited to be rescued. A witness to the amusement park ride malfunction also noted that, “The ride went up, the kids got stuck on the ride and they were just dangling…And somebody came in and said, ‘Hey, the kids are stuck on the ride’ and I look up, and sure enough, they were stuck on the ride.” Importantly, when the AtmosFEAR ride stopped, Oaks Park staff was able to return the ride to its unloading position within around 30 minutes.

Justice for Victims of Amusement Park Accidents in Knoxville

The harrowing incident at Oaks Park in Oregon serves as an example of how a fun time at an amusement park can turn in an instant. Fortunately, in Knoxville, when a person is injured at an amusement park due to the negligent maintenance of the park rides or equipment, they may have a claim for compensation against the amusement park owner or amusement park property owner under Tennessee premises liability laws. Importantly, there is a limited time to file a claim under Tennessee premises liability laws, so it is best to speak with an experienced Knoxville premises liability lawyer as soon as possible about your rights and options after you are seriously injured at an amusement park or on amusement park property.
