Child Support and Spousal Maintenance
Child support is designed to make sure the financial needs of children in a divorce are covered. The non-custodial parent will make pre-determined monthly payments to the custodial parent. The amount is determined based on the number of children needing support and the parent’s combined income.
Spousal maintenance, also known as spousal support or alimony, is court-ordered payments one spouse makes to the other after a divorce. Tennessee passed legislation in 2005 that defined four types of alimony for the state to recognize. They are:
- Rehabilitative alimony – This is designed to help the economically less-advantaged spouse receive support until they can transition into supporting themselves at the same standard of living.
- Transitional alimony – This is similar to rehabilitative alimony, except there is no need for the economically disadvantaged to make changes to support themselves. Transitional alimony is merely to allow the spouse to adjust to the economic changes that divorce brings.
- Alimony in futuro – This allows spousal support to be made in through property instead of money payments.
- Alimony in solido – This is a lump sum amount that can be made in payments or all at once instead of monthly payment made for life, until a spouse remarries, or other conditions in which spousal support may change.
Child Custody
What happens to the children in any divorce is a heated topic. To make sure there are concrete decisions made prior to the divorce, Tennessee requires each divorce to be accompanied with a parenting plan. Parenting plans determine who has custody over the children at different points during the week and year. It also designates which parents will make legal and medical decisions on the child’s behalf. Research done by the American Psychological Association shows that children fare better with a customized parenting plans that accounts for their developmental stages and relationships they have with their parents.
