Woman Dies from Eating at Disney Amusement Park Pub Despite Amusement Park Wait Staff Assurances of “Allergen-Free” Food; Disney Attempts to Bar Wrongful Death Lawsuit Due to Disney+ Subscription Arbitration Agreement
Few things are more devastating than a family outing to a beloved, world-renowned amusement park ending in tragedy.. Unfortunately, this was the case for a couple who visited the Walt Disney World resort in Orlando, Florida. According to national news reports, CNN Business News, Jeffery Piccolo now seeks damages for the loss of his wife, Kanokporn Tangsuan, who died as a result of eating allergen-laden food at a Disney restaurant in the Disney Springs amusement park. In October, 2023, the couple and Piccolo’s mother ate at the Raglan Road Irish Pub at the Disney Springs amusement park (part of Walt Disney World Resort). The couple chose the establishment because they thought that it would be a safe place for Tangsuan, who had severe food allergies to dairy and nuts, to eat. After checking multiple times with wait staff that Tangsuan’s selections (vegan fritters, scallops, onion rings, and a vegan shepherd’s pie) were allergen-free, the couple ate at the restaurant. After eating at the pub, the couple went shopping in Disney Springs. However, Tangsuan began suffering from a severe allergic reaction and she died despite attempts to save her with an Epi-Pen. As a result of his wife’s tragic and horrifying death, Piccolo filed a wrongful death lawsuit against the amusement park for damages including damages under Florida’s Wrongful Death Act, pain and suffering, loss of companionship and protection, loss of income, and medical and funeral expenses. Regarding the terrible loss of Tangsuan, who was only 42 years old when she died, Disney released the following statement: “We are deeply saddened by the family’s loss and understand their grief…Given that this restaurant is neither owned or operated by Disney, we are merely defending ourselves against the plaintiff’s attorney’s attempt to include us in their lawsuit against the restaurant.” Disney has raised several defenses to Piccolo’s lawsuit, including that he is barred from bringing a civil suit in court because he signed an arbitration agreement when he signed up for the media giant’s Disney+ streaming service. Before the court considered whether such an arbitration agreement could bar Piccolo’s suit, Disney withdrew its request for arbitration under intense public scrutiny.
